Notice pursuant to Section 7

1. Collection of Personal Data

This Personal Data Notice is issued to all our valued customers / prospective customers, pursuant to the requirements of the Malaysian Personal Data Protection Act 2010.

In the course of your dealings with us, Sunsuria Berhad and/or its group of Companies (hereinafter collectively referred to as “Sunsuria”) as our valued customer / prospective customer, we will request that you provide data and information about yourself (“Personal Data”) to enable us to enter into transaction with you or to deliver the necessary notices, services and/or products in connection with our business. These are relevant in connection with our business process, execution, including delivery of notices, services and/or products, client relationship management, planning purposes in connection with future products, new product launches and events including promotional events with business partners within our projects/townships.

We treat and view the maintenance and processing of your Personal Data with utmost importance.

2. Nature of Personal Data

Such Personal Data may be subject to applicable data protection, privacy and other similar laws and may include but not limited to information concerning name, age, identity card number, passport number, address, gender, date of birth, children basic details, marital status, occupation, income range, contact information, email address, employer, race, ethnic origin, nationality, type of loans applied for in relation to the purchase of property, introducer’ name, address and identity card number and such other relevant information to enable Sunsuria to provide you with Sunsuria’s services and products.

3. Impact resulting from failure to supply Personal Data

The failure to supply such Personal Data will:-

• result in us being unable to provide customers / prospective customers with the notices, services and/or products requested;
• affect the ability of the parties to enter into the necessary Sales and Purchase Agreement in relation to the sale of property and/or product; and/or
• result in us being unable to update you on our latest product and/or launches.

4. Purpose of collecting Personal Data

Personal Data you provide will be collected, used and otherwise processed by us for, amongst others, the following purposes:

• to send you invites to Sunsuria’s property launches, promotional materials, advertisements for marketing purposes, and for administrative purposes;
• to alert and recommend properties similar to those properties you have purchased (if any);
• the delivery of notices, services or products and the marketing of such services or products whether present or future, to you;
• in order for you to enter into the necessary agreement and/or contract to purchase the products and/or properties from us (for real estate customers only);
• user or customer relationship management procedures;
• those purposes specifically provided for in any particular service or product offered by us;
• conducting marketing and client profiling activities in connection with our services and related products;
• credit assessments and other background checks of users as we may determine to be necessary or appropriate;
• our internal record keeping;
• collection of outstanding payments from clients;
• prevention of crime (including but not limited to fraud, money-laundering, bribery);
• meeting any legal or regulatory requirements relating to our provision of services and products and to make disclosure under the requirements of any applicable law, regulation, direction, court order, by-law, guideline, circular, code applicable to us or any member companies of our Group;
• purposes relating to any of the above (including but not limited to research, benchmarking and statistical analysis);

• post vacant possession services, such as club house services, security and customer loyalty programmes.

Personal Data provided to us will generally be kept confidential but you hereby consent and authorize us to provide or disclose your Personal Data to the following categories of parties:-

• any person to whom we are compelled or required to do so under law or in response to a competent or government agency;
• any related, affiliated, holding, subsidiaries, successors in title of Sunsuria, including those established in the future;
• business partners and affiliates of Sunsuria;
• government agencies, statutory authorities and industry regulators including but not limited to municipal councils, land offices and housing and development boards;
• auditors, consultants, accountants, lawyers or other financial or professional advisers of Sunsuria;
• contractors, sub-contractors of Sunsuria or third party service or product providers as may determine to be necessary or appropriate;
• third party property management companies/entities in respect of the management of property that customers have purchased; and/or
• appointed service providers of Sunsuria in relation of our loyalty programs, for the purpose of delivery of gift redemption and services;
• companies who provide utilities and other services including but not limited to the following utilities providers:-
  • Tenaga Nasional Berhad;
  • Syarikat Bekalan Air Selangor Sdn Bhd; and
  • Indah Water Konsortium.
  • actual or prospective purchasers in the event Sunsuria decide to divest part or all of our business through a sale, merger or acquisition; and
  • other parties such as:-
  • The Joint Management Body;
  • The Management Corporation; and
  • Banks, financier institutions and their valuers.

6. Safeguards

We shall keep and process your data in a secure manner. We endeavour, where practicable, to implement the appropriate administrative and security safeguards and procedures in accordance with the applicable laws and regulations to prevent the unauthorized or unlawful processing of your Personal Data and the accidental loss or destruction of, or damage to, your Personal Data.

7. Data Transfer & Sharing

Where we consider it necessary or appropriate for the purposes of data storage or processing or providing any service or product on our behalf to you, we may transfer your Personal Data to another member of our Group or third party service or product providers within or outside the country in which we are established, under conditions of confidentiality and similar levels of security safeguards.

8. Your Rights of Access and Correction

8.1 You have the right to request access to and make correction of information about you held by us and in this respect, you may:

• check if we hold or use your Personal Data and request access to your Personal Data in our records for verification purposes;
• request that we correct any of your Personal Data that is inaccurate, incomplete or out-of-date;
• request that your Personal Data is retained by us only as long as necessary for the fulfilment of the purposes for which it was collected;

In accordance to Section 7(3) Personal Data Protection Act 2010, this Notice is issued in both the national and English languages. In the event of any inconsistency, the English language version of this Notice shall prevail.

1. Pengumpulan Data Peribadi

Notis Data Peribadi ini dikeluarkan kepada semua pelanggan / bakal pelanggan kami yang dihargai, selaras dengan keperluan Akta Perlindungan Data Peribadi Malaysia 2010.

Sewaktu anda berurusan dengan kami, Sunsuria Berhad dan/atau Kumpulan Syarikat (kemudian dikenali secara kumpulan sebagai “Sunsuria”) sebagai pelanggan / bakal pelanggan kami yang dihargai, kami akan meminta anda memberikan data dan maklumat tentang diri anda (“Data Peribadi”) untuk membolehkan kami memasuki urus niaga dengan anda atau menyampaikan notis, perkhidmatan dan/atau produk berhubung dengan perniagaan kami. Hal ini adalah relevan bagi proses perniagaan kami, pelaksanaannya, termasuk penyampaian notis, perkhidmatan dan/atau produk, pengurusan perhubungan pelanggan, tujuan perancangan berkenaan dengan produk akan datang, pelancaran produk baru dan acara-acara termasuk acara promosi dengan rakan kongsi perniagaan dalam projek atau perbandaran kami.

Kami menganggap dan memandang pemeliharaan dan pemprosesan Data Peribadi anda dengan kepentingan utama.

2. Sifat Data Peribadi

Data Peribadi tersebut mungkin tertakluk kepada undang-undang perlindungan data, privasi dan undang-undang serupa lain yang terpakai dan mungkin merangkum tetapi tidak terhad kepada maklumat tentang nama, usia, nombor kad pengenalan, nombor pasport, alamat, jantina, tarikh lahir, butir-butir asas tentang anak, status perkahwinan, pekerjaan, julat pendapatan, maklumat hubungan, alamat e-mel, majikan, bangsa, asal-usul etnik, kewarganegaraan, jenis pinjaman yang dipohon berhubung dengan pembelian harta, nama, alamat dan nombor kad pengenalan pengenal dan sebarang tujuan yang berkaitan dengan produk dan perkhidmatan yang disediakan oleh Sunsuria.

3. Kesan kegagalan untuk memberikan Data Peribadi

Kegagalan untuk membekalkan Data Peribadi akan:-

• menyebabkan kami tidak dapat menyampaikan notis, perkhidmatan dan/atau produk yang diminta kepada pelanggan / bakal pelanggan;
• menjejaskan keupayaan pihak-pihak untuk memasuki Perjanjian Jual Beli yang perlu berhubung dengan penjualan harta dan/atau produk; dan/atau
• mengakibatkan kami tidak dapat mengemaskinikan anda tentang produk dan/atau pelancaran terkini kami.

4. Tujuan Pengumpulan Data Peribadi

Data Peribadi yang diberikan oleh anda akan dikumpul, digunakan dan sebaliknya diproses oleh kami antara lainnya bagi tujuan berikut:

• untuk menghantar anda jemputan ke pelancaran hartanah Sunsuria, bahan promosi, iklan untuk tujuan pemasaran, untuk tujuan pentadbiran;
• untuk memberitahu dan memberi cadangan mengenai hartanah yang menyerupai hartanah yang telah dibeli sebelum ini (jika ada);
• penyampaian notis, perkhidmatan atau produk dan pemasaran perkhidmatan atau produk tersebut sama ada pada masa kini atau di masa hadapan, kepada anda;
• agar anda dapat memasuki perjanjian dan/atau kontrak yang perlu untuk membeli produk dan/atau harta daripada kami (untuk pelanggan hartanah sahaja);
• prosedur pengurusan perhubungan pengguna atau pelanggan;
• tujuan yang diperuntukkan dengan nyata dalam sebarang perkhidmatan atau produk khusus yang ditawarkan oleh kami;
• menjalankan aktiviti pemasaran dan pemprofilan pelanggan berhubung dengan perkhidmatan dan produk berkaitan kami;
• penilaian kredit dan semakan latar belakang lain terhadap pengguna sepertimana kami anggap perlu atau sesuai;
• penyimpanan rekod dalaman kami;
• pungutan pembayaran belum dijelaskan daripada pelanggan;
• menghalang jenayah (termasuk tetapi tidak terhad kepada penipuan, pengubahan wang haram, rasuah);
• memenuhi sebarang keperluan undang-undang atau kawal selia berkaitan dengan penyediaan perkhidmatan dan produk oleh kami dan untuk membuat pendedahan di bawah keperluan sebarang undang-undang yang terpakai, peraturan, arahan, perintah mahkamah, undang-undang kecil, garis panduan, pekeliling, kod yang terpakai kepada kami atau mana-mana syarikat ahli Kumpulan kami; dan
• tujuan berkaitan dengan mana-mana satu daripada perkara di atas (termasuk tetapi tidak terhad kepada penyelidikan, penanda aras dan analisis perangkaan).
• membolehkan kami menghantar maklumat kepada anda melalui e-mel, kaedah telekomunikasi (panggilan telefon atau pesanan teks) atau media sosial tentang produk dan perkhidmatan yang ditawarkan oleh pihak ketiga tertentu yang kami anggap mungkin menarik minat anda tetapi semasa berbuat demikian kami akan terus mengawal Data Peribadi anda dan kami tidak akan mendedahkan Data Peribadi anda kepada pihak ketiga tanpa kebenaran terdahulu anda;
• milikan kosong, penyerahan kunci, pengurusan harta/hartanah, jagaan pelanggan dan/atau kerja-kerja pembaikan kecacatan; dan/atau
• perkhidmatan pasca milikan kosong, seperti perkhidmatan rumah kelab, keselamatan dan program kesetiaan pelanggan.

5.  Pendedahan

Data Peribadi yang diberikan kepada kami secara amnya akan dirahsiakan tetapi anda dengan ini membenarkan dan memberi kuasa kepada kami untuk memberikan atau mendedahkan Data Peribadi anda kepada kategori pihak berikut:-

• mana-mana orang kepada mana kami terpaksa atau dikehendaki berbuat demikian di bawah undang-undang atau sebagai balasan kepada agensi kompeten atau kerajaan;
• mana-mana syarikat atau pihak yang berkaitan, syarikat gabungan, ibu syarikat, anak syarikat dan pengganti hakmilik Sunsuria, termasuk yang ditubuhkan di masa hadapan;
• rakan kongsi perniagaan dan anggota gabungan dalam talian Sunsuria;
• agensi kerajaan, pihak berkuasa berkanun dan pengawal selia industri termasuk tetapi tidak terhad kepada majlis-majlis perbandaran, pejabat-pejabat tanah dan lembaga-lembaga perumahan dan pembangunan;
• juruaudit, perunding, akauntan, peguam kami atau penasihat kewangan atau profesional Sunsuria yang lain;
• kontraktor, subkontraktor Sunsuria atau penyedia perkhidmatan atau produk pihak ketiga sebagaimana kami anggap perlu atau sesuai;
• syarikat/entiti pengurusan harta pihak ketiga berhubung dengan pengurusan harta yang dibeli oleh pelanggan; dan/atau
• penyedia perkhidmatan yang dilantik oleh kami berhubung dengan program kesetiaan Sunsuria, bagi tujuan penyampaian hadiah yang ditebus dan perkhidmatan.
• syarikat-syarikat yang memberikan kemudahan-kemudahan dan perkhidmatan lain, termasuk tetapi tidak terhad kepada pembekal-pembekal kemudahan berikut:
  • Tenaga National Berhad;
  • Syarikat Bekalan Air Selangor Sdn Bhd; dan
  • Indah Water Konsortium
  • pembeli-pembeli sebenar atau bakal pembeli sekiranya Sunsuria membuat keputusan untuk melupuskan sebahagian atau semua perniagaan kami melalui jualan, penggabungan atau pengambilalihan; dan
  • pihak-pihak lain seperti:
  • Badan Pengurusan Bersama;
  • Perbadanan Pengurusan; dan
  • Bank-bank dan penilai-penilai bank.

6. Pelindung

Kami akan menyimpan dan memproses data anda dalam cara yang selamat. Kami akan berusaha sedaya upaya, di mana praktik, untuk melaksanakan pelindung dan prosedur pentadbiran dan keselamatan yang sesuai selaras dengan undang-undang dan peraturan yang terpakai untuk menghalang pemprosesan Data Peribadi anda dalam cara yang tidak dibenarkan atau tidak sah dan kehilangan atau kemusnahan atau kerosakan pada Data Peribadi anda dalam cara yang tidak disengajakan.

7. Pemindahan & Perkongsian Data

Sekiranya kami menganggapnya perlu atau sesuai bagi tujuan penyimpanan atau pemprosesan data atau untuk menyediakan sebarang perkhidmatan atau produk bagi pihak kami kepada anda, kami boleh memindahkan Data Peribadi anda kepada ahli lain dalam syarikat-syarikat Kumpulan kami atau penyedia perkhidmatan atau produk pihak ketiga di dalam atau di luar negara di mana kami ditubuhkan, dalam keadaan kerahsiaan dan tahap pelindung keselamatan yang serupa.

8. Hak Akses dan Pembetulan Anda

8.1 Anda berhak meminta akses kepada dan membuat pembetulan maklumat tentang anda yang disimpan oleh kami dan dalam hal ini, anda boleh:

• memeriksa jika kami memegang atau menggunakan Data Peribadi anda dan meminta akses kepada Data Peribadi anda di dalam rekod-rekod kami untuk tujuan verifikasi;
• meminta agar kami membetulkan sebarang Data Peribadi anda yang tidak tepat, tidak lengkap atau ketinggalan zaman;
• meminta agar Data Peribadi anda disimpan oleh kami hanya selama mana yang perlu untuk memenuhi tujuan maklumat tersebut dikumpul;
• meminta agar kami menyatakan atau menjelaskan dasar dan prosedurnya berkaitan dengan data dan jenis Data Peribadi yang dikendalikan oleh kami; dan
• memaklumkan kepada kami bantahan anda tentang penggunaan Data Peribadi anda bagi tujuan pemasaran dan dengan itu kami tidak akan menggunakan Data Peribadi anda bagi tujuan ini.
